Divorce proceedings begin as contested, by the filing of a Complaint for Divorce, or uncontested, with the filing of Joint Petition. Cases that start as contested may easily become uncontested if the parties can agree to a set of terms to settle all of their differences.  The Massachusetts divorce court must also consider the couple’s concerns about continuing coverage of health insurance, taxes, and life insurance. A couple may elect to resolve their differences with terms in a written Separation Agreement. If the couple is unable to resolve these issues by agreement, the issues will be presented to the court for determination.
